Kept Terms of Use

Last updated: October 30, 2026

Acceptance

By downloading or using Kept (“Kept”), you agree to these terms. If you do not agree, do not use the app. Kept is licensed to you under Apple’s Standard Licensed Application End User License Agreement (the “Apple EULA”). These terms add details specific to Kept; where they conflict with the Apple EULA, the Apple EULA controls. Kept is operated by Harsh Patel.

What Kept is

Kept is a private custody record for one parent. It helps you keep your custody plan on a calendar, log handoffs against it, and keep expenses, messages, notes, day changes and photos in one record with a change history, then share a PDF report or a read only copy with people you choose.

  • Kept is a record keeping tool, not legal advice, and not a law firm. Nothing in the app or on this website is legal advice. For advice about your situation, talk to a qualified family law attorney.
  • Kept does not read, interpret or enforce your custody order or agreement. The calendar shows the pattern you set up, and “As planned” only compares the times you enter with that pattern.
  • Kept makes no promise about how an attorney, mediator, judge or anyone else will view or use your record.
  • Entry times come from your iPhone’s clock. Totals, splits and text read from screenshots are calculated from what you enter and can contain errors. Check them before you share a report.
  • Kept is not an emergency or reporting service. If anyone is in danger, call 911 or your local emergency number.

Your content

The entries, photos and documents you add belong to you. We do not claim ownership of your content. It stays on your iPhone and in your private iCloud unless you export it or share it.

Kept Pro

  • Adding and changing entries and your plan needs Kept Pro.
  • Without Kept Pro, or after it ends, your record stays on your iPhone and in your iCloud and remains yours. You can view, export and share it at any time. Nothing is deleted.
  • People you share your record with read it without a subscription and cannot change it.
  • We may change features in future versions. Records you already created remain yours.

Subscriptions

  • Kept Pro is an optional automatically renewing subscription, offered yearly ($59.99 per year) or monthly ($9.99 per month) in the United States. Prices vary by country and region; the exact price is shown in the app and in Apple’s purchase sheet before you buy.
  • Eligible new subscribers get a 7 day free trial of yearly. Unless you cancel at least 24 hours before the trial ends, it converts to a paid subscription at the price shown. Any unused portion of a free trial is forfeited when you purchase a subscription. Monthly has no trial.
  • Kept may offer a first year for $29.99, then $59.99 per year, open for 48 hours once. After Kept Pro ends, some people may be offered a year for $29.99, then $59.99 per year. At most one of these is offered at a time, and the offer price and the renewal price are shown before you confirm.
  • Payment is charged to your Apple Account when you confirm the purchase, or when a free trial ends. Subscriptions renew automatically at the same price and period unless auto renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
  • Manage or cancel anytime in Settings > [your name] > Subscriptions on your iPhone, or at apps.apple.com/account/subscriptions. Cancellation takes effect at the end of the current billing period.
  • Apple handles billing and refunds. Request a refund at reportaproblem.apple.com. We never receive your payment card details.

Acceptable use

  • Use Kept only for lawful, personal record keeping.
  • Do not use Kept to harass, stalk or monitor another person.
  • Only add messages, photos and documents you have the right to keep and share.
  • Do not attempt to disrupt the app or its services, bypass subscriptions, or reverse engineer the app except where the law allows it.

Third party services

Kept uses Apple services, including iCloud and Apple’s sharing, plus RevenueCat and PostHog. Their availability is outside our control. See the privacy policy for what each service receives.

Availability and changes

Kept is provided “as is” and may contain bugs or interruptions. iCloud sync and sharing depend on Apple and your connection. Keep your own copy with Settings > Download a copy. We may update, change, suspend or discontinue parts of the app. If these terms materially change, we will update this page and the date above.

Limitation of liability

To the maximum extent permitted by law, Harsh Patel is not liable for custody or family law outcomes, decisions made by any other person, lost data, or indirect or consequential damages arising from your use of Kept, and total liability for any claim is limited to the amount you paid for Kept in the 12 months before the claim. Nothing in these terms limits rights you have under consumer law that cannot be waived.

Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts, USA, excluding its conflict of law rules. Any dispute will be resolved in the state or federal tribunals located in Massachusetts. If you are a consumer, nothing in these Terms limits mandatory consumer protection rights you have under the laws of your country of residence.
